By accessing or using our Service, you agree to be bound by these Terms, which constitute a legally binding agreement between you and OG INBOX. 1. Description of Service
OG INBOX provides users with an Artificial Intelligence (AI) driven email marketing and audience management platform. The service involves managing contact lists, defining behavioral triggers, generating personalized email sequences using AI, and delivering these campaigns through authorized third-party providers (e.g., Amazon SES) to ensure high deliverability and domain protection.
2. User Accounts and Eligibility
To use our Service, you must register for an account. By registering, you warrant that you are at least 18 years of age and legally capable of entering into binding contracts under the Indian Contract Act, 1872. You must provide accurate, current, and complete information during registration and keep your account details secure. You are solely responsible for all activities under your account.
3. Wallet Credits, Billing & Pricing
Our service operates on a prepaid "Wallet" or credit system. Users purchase credits via supported payment gateways (e.g., Razorpay, Cashfree, Stripe) which are consumed upon using the AI generation features (e.g., creating an email campaign or sequence). All pricing is clearly displayed on our platform and may be subject to applicable taxes (such as GST in India). In compliance with the Reserve Bank of India (RBI) guidelines, all payments are securely processed by authorized payment aggregators, and we do not store your complete card data.
4. Content Liability & Intellectual Property
The content generated by our AI is for professional communication purposes. Since AI generation relies on probabilistic models, we do not guarantee the absolute factual accuracy or the conversion rate of the output.
- Your Responsibility: You are solely responsible for reviewing, editing, and verifying the AI-generated emails and campaign settings before sending them to your audience.
- Ownership: You retain ownership of the campaign content generated using your prompts and platform credits, subject to the terms of the underlying AI providers (e.g., OpenAI, Anthropic).
- Prohibited Use: You may not use the Service to generate or send spam, illegal, hateful, defamatory, or copyright-infringing content.
5. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall OG INBOX, its directors, employees, partners, or suppliers be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data (including audience lists), use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content.
6. Indemnification
You agree to defend, indemnify and hold harmless OG INBOX and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password, or b) a breach of these Terms.
7. Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Service will immediately cease. Any unused wallet credits upon termination due to a violation of these terms will be forfeited.
8. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any legal disputes or proceedings shall be subject to the exclusive jurisdiction of the competent courts in Uttar Pradesh, India.
