1 Description of Service

OGINBOX provides an Artificial Intelligence (AI) powered email marketing and audience orchestration platform. Key functionalities include:

• Managing recipient contact lists, audience segments, and behavioral triggers.
• Generating personalized email sequences and transactional campaigns using generative AI reasoning.
• Delivering outgoing campaigns via enterprise mail transfer agents (such as Amazon SES) with deliverability jitter, rate limiting, and bounce suppression.
• Synchronizing e-commerce events (such as Shopify abandoned checkouts) and classifying inbound replies.

2 User Accounts & Eligibility

By registering for an account, you represent and warrant that you are at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872. You must provide truthful, complete, and updated information during sign-up. You are exclusively responsible for maintaining the confidentiality of your login credentials and for all activities executed under your account.

3 Wallet Credits, Billing & Pricing

Our platform operates on a prepaid Wallet Credit model:

• Credit Consumption: Credits are deducted in real-time when AI sequence generation is triggered or outbound emails are queued for delivery.
• Payment Processors: Recharges are processed via authorized payment aggregators (including Razorpay, Cashfree, Stripe, and PayPal). In compliance with Reserve Bank of India (RBI) tokenization mandates, complete credit card numbers and CVVs are never retained on our servers.
• Taxes: All listed prices are exclusive of applicable statutory taxes (such as Indian Goods and Services Tax / GST), which will be itemized at checkout.

The copy and strategies generated by our platform utilize advanced large language models that operate probabilistically:

5 Prohibited Use & Anti-Spam Rules

To protect shared sending infrastructure and ensure zero tolerance for abuse, Users agree NOT to:

• Upload or send to scraped, purchased, harvested, or third-party rented email lists lacking explicit opt-in consent.
• Distribute content that is fraudulent, phishing, defamatory, adult/explicit, hateful, or in violation of intellectual property laws.
• Manipulate or suppress mandatory RFC 8058 one-click unsubscribe links or physical postal address footer tokens.
• Exceed our deliverability safety boundaries (maintaining a spam complaint rate higher than 0.08%).

6 Limitation of Liability & Indemnification

To the maximum extent permitted by applicable law, in no event shall OGINBOX, its directors, employees, or technology licensors be liable for any indirect, incidental, punitive, or consequential damages, including loss of business profits, audience lists, domain blacklisting, or delivery delays resulting from ISP outages.

You agree to defend, indemnify, and hold harmless OGINBOX against any claims, liabilities, damages, or expenses (including legal fees) arising from your campaigns or violation of these Terms.

7 Termination & Credit Forfeiture

We reserve the right to suspend or permanently terminate your account immediately, without prior notice, if you breach these Terms or generate high spam complaint spikes. Upon termination for breach of conduct, access to the platform will cease immediately and any unused prepaid wallet credits will be forfeited without refund.

8 Governing Law & Legal Jurisdiction

These Terms of Service shall be governed by, interpreted, and construed in accordance with the substantive laws of India, without regard to principles of conflicts of law.
